MAPE FAQ: Layoff Notices & Potential State Shutdown (2025)

This document answers the most common questions members have about layoff notices and the possibility of a state government shutdown starting July 1, 2025. Please note: Some of the items below are reflective of a Memorandum of Understanding process prior to a shutdown. We are currently working with the State on that process. If anything changes as a result of that process, we will update this document accordingly. For now, we are moving forward with this FAQ as we have in past potential shutdowns.
Q: Why might I receive a layoff notice?
A: If the Minnesota Legislature does not pass a state budget by June 1, agencies are contractually required to issue at least a 21-day layoff notice to employees who would be affected by a potential shutdown beginning July 1. Notices will go out between June 2-10.
These notices are precautionary, not a guarantee that layoffs will occur.
Q: If I get a layoff notice, am I immediately laid off?
A: No. You will continue to be employed, report to work as scheduled, and receive full pay and benefits through June 30. If a budget is not passed by July 1, you will be laid off beginning July 1.
Q: What happens if a shutdown begins on July 1?
A: If a budget is not passed and a shutdown begins:
- You will be laid off. You may not use vacation or sick leave during the shutdown.
- You will retain your health insurance with the same premium costs.
- You will retain your health insurance with the same premium costs.
- You will be eligible to apply for Unemployment Insurance benefits starting July 1.
Q: Will I be recalled to my job after the shutdown ends?
A: Yes. Once a budget is passed, you will be issued a recall notice and return to:
- Your same job classification
- The same location and work schedule
- With full seniority and leave accrual intact
- You will receive backpay, per Minn. Stat. 16A.1335, Subd. 2. If you received any unemployment insurance payments, you would have to pay that back.
Q: What if I’m told I’m “critical staff”?
A: Some employees may be designated as critical or essential. These employees:
- Will continue working during a shutdown
- Will continue to be paid
- Will be notified of their status by their agency
Q: What if my layoff notice is incorrect or premature?
A: Contact your MAPE steward immediately. MAPE will challenge improper notices and ensure that the process follows contractual protections.
Q: What can I do to prepare?
- Know who to contact: If you receive a layoff notice or have questions about your classification, seniority, or employment status, contact your MAPE steward for support.
- Stay engaged and take action: The most important thing you can do right now is stay connected and visible. Join your Contract Action Team (CAT) meetings, attend upcoming info pickets and be ready to act if called on—whether that’s sharing your story, contacting legislators, or showing up for a solidarity action.
